1. Acceptance of Terms ¶
By downloading and using Murmur ("the App"), you agree to these Terms & Conditions. If you do not agree, please do not use the App.
2. Use of the App ¶
- The App is designed to help users practice phone conversations and reduce phone anxiety through AI-powered simulations
- You may use the App for personal, non-commercial use only
- You agree not to reverse engineer, modify, or create derivative works from the App
- The App is not a substitute for professional mental health treatment
3. AI-Powered Features ¶
- The App uses AI-powered voice conversations to simulate realistic phone call scenarios
- AI responses are generated in real-time and may vary
- We do not guarantee specific outcomes or anxiety reduction results
- Voice interactions are processed using third-party AI services (ElevenLabs, OpenAI)
4. Intellectual Property ¶
- All content, including but not limited to text, graphics, logos, practice scenarios, and software, is the property of Murmur
- User-created custom scenarios remain the property of the user
- User progress data, transcripts, and achievements belong to the user
5. User Conduct ¶
- You agree to use the App responsibly and not for any unlawful purpose
- You will not create scenarios that violate laws or harm others
- You will not attempt to interfere with the App's functionality or security
- You are responsible for maintaining the confidentiality of your account
6. Subscriptions and Purchases ¶
- The App offers both free and premium features
- Free users receive 3 practice calls
- Premium subscriptions provide unlimited practice calls and advanced scenarios
- Subscription pricing is displayed in the App and may vary by region
- Subscriptions automatically renew unless cancelled 24 hours before renewal
- You can manage subscriptions in your App Store account settings
- All purchases are final and non-refundable except as required by law or at our discretion
7. Disclaimer of Warranties ¶
- The App is provided "as is" without warranties of any kind
- We do not guarantee specific therapeutic outcomes or anxiety reduction
- AI conversations may occasionally produce unexpected or inaccurate responses
- We are not responsible for any errors or omissions in AI-generated content
- The App is not a replacement for professional mental health care
8. Limitation of Liability ¶
- We shall not be liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the App or subscription
- We are not liable for third-party AI service interruptions or errors
9. Health Disclaimer ¶
- Murmur is a practice and confidence-building tool, not medical treatment
- If you experience severe anxiety or mental health concerns, please consult a licensed healthcare professional
- The App should be used as a supplement to, not replacement for, professional care
10. Changes to Terms ¶
- We reserve the right to modify these terms at any time
- You will be notified of material changes through the App
- Continued use of the App constitutes acceptance of modified terms
11. Termination ¶
- We reserve the right to suspend or terminate accounts that violate these terms
- You may delete your account at any time through the App settings
- Upon termination, all user data will be permanently deleted

Privacy Policy ¶
1. Information We Collect ¶
Information You Provide:
- Optional display name for personalization
- Custom practice scenarios you create
- Practice call transcripts (if you enable transcript storage)
- Feedback and support messages
Information We Automatically Collect:
- Practice session data (duration, completion, XP earned)
- Progress metrics (level, streak, achievements, confidence score)
- App usage analytics (anonymized unless you opt-out)
- Device information (iOS version, device model for compatibility)
Information We Do NOT Collect:
- Real names, email addresses, or contact information (unless you contact support)
- Location data or GPS coordinates
- Photos or media files from your device
- Contacts or calendar information
- Financial information (handled by Apple's App Store)
2. How We Use Information ¶
To Provide Core Features:
- Store your practice progress, achievements, and statistics
- Generate personalized feedback and recommendations
- Track streaks and gamification elements
- Sync data across your devices via CloudKit
To Improve the App:
- Analyze usage patterns to improve scenarios and features
- Monitor app performance and fix bugs
- Develop new practice scenarios based on popular categories
For AI Features:
- Send voice recordings to ElevenLabs for AI conversation generation
- Process transcripts with OpenAI for feedback analysis (if enabled)
- Voice data is not permanently stored by third-party services
3. Data Storage and Security ¶
Local Storage:
- All user progress, scenarios, and preferences stored locally via SwiftData
- Practice transcripts stored only if you enable the feature
- Data persists on your device until you delete the app
Cloud Sync:
- Optional iCloud sync via CloudKit for cross-device access
- All cloud data is encrypted and private to your Apple ID
- You can disable iCloud sync in iOS Settings
Third-Party AI Processing:
- Voice recordings temporarily sent to ElevenLabs for conversation generation
- Transcripts may be sent to OpenAI for feedback analysis (optional)
- These services process data per their respective privacy policies
- No permanent storage of voice recordings by third parties
4. Third-Party Services ¶
The App integrates with the following services:
ElevenLabs (Voice AI):
- Processes voice recordings for realistic AI conversations
- Used only during active practice calls
- Governed by ElevenLabs' privacy policy
OpenAI (Feedback Analysis):
- Analyzes practice call transcripts to generate feedback
- Used only when you enable transcript storage
- Governed by OpenAI's privacy policy
Apple CloudKit (Optional Sync):
- Syncs your progress across Apple devices
- Encrypted and tied to your Apple ID
- Governed by Apple's privacy policy
Analytics (Optional):
- Anonymized usage analytics to improve the app
- You can opt-out in Settings
- No personally identifiable information collected
Sentry (Error Tracking):
- Crash reports and error logs to improve stability
- Anonymized and contains no personal data
5. Data Sharing ¶
We Do NOT:
- Sell, trade, or rent your personal information
- Share data with advertisers or marketing companies
- Provide data to third parties except as described below
We May Share:
- Anonymized, aggregated analytics for app improvement
- Data with service providers (ElevenLabs, OpenAI) as necessary for features
- Information if required by law or to protect our rights
6. Your Privacy Rights ¶
Access and Control:
- View all your practice history in the Profile section
- Export or delete your custom scenarios
- Clear practice history at any time
- Delete your account and all associated data
Data Portability:
- All data is stored locally on your device
- You can access practice transcripts if enabled
- Progress data syncs via your iCloud account
California Privacy Rights (CCPA):
- Right to know what data is collected (see section 1)
- Right to delete your data (delete the app or account)
- Right to opt-out of data sale (we don't sell data)
European Privacy Rights (GDPR):
- Legal basis: Contract performance and legitimate interest
- Right to access: View data in the app
- Right to erasure: Delete account or app
- Right to data portability: Export scenarios and transcripts
- Right to object: Disable analytics in settings
7. Children's Privacy ¶
- The App is intended for users 13 years and older
- We do not knowingly collect data from children under 13
- If we learn we've collected data from a child under 13, we will delete it
- Parents should supervise their children's use of the app
8. Data Retention ¶
- Active accounts: Data retained as long as you use the app
- Deleted accounts: All data permanently deleted within 30 days
- Transcript storage: Controlled by your settings, can be cleared anytime
- Analytics: Anonymized data may be retained for statistical purposes
9. International Data Transfers ¶
- Data may be processed in the United States and other countries
- AI services (ElevenLabs, OpenAI) may process data internationally
- We ensure adequate safeguards are in place per applicable laws
10. Security Measures ¶
- End-to-end encryption for iCloud sync via Apple CloudKit
- Secure HTTPS connections for all network communications
- Regular security audits and updates
- No plain-text storage of sensitive information
11. Changes to Privacy Policy ¶
- We will notify users of material changes via in-app announcements
- The "Last updated" date will reflect recent changes
- Continued use constitutes acceptance of changes

12. Do Not Track ¶
- We respect browser "Do Not Track" signals
- Opt-out of analytics in Settings to limit data collection
- Third-party AI services have their own tracking policies
